WHAT CAN BE REGISTERED AS A TRADEMARK IN BAHRAIN ?

WHAT CANNOT BE REGISTERED AS A TRADEMARK IN BAHRAIN ?
While Bahrain provides extensive trademark protection, certain marks are restricted from registration. The following categories are prohibited:

- Flags of Bahrain, Arab nations, foreign countries, or international organizations
- Red Crescent or Red Cross emblems
- Marks identical to religious emblems or insignias

FILING REQUIREMENTS IN BAHRAIN
Trademark applications in Bahrain must be submitted in Arabic. If an application is initially filed in English, an official Arabic translation must be provided within four months.To establish a filing date, applicants must submit the following details:
- Applicant’s full name, nationality, and address
- A list of goods and services under the trademark application
- A clear representation of the trademark
- A notarized Power of Attorney (PoA)
A certified copy of the Priority Document (if applicable), with an Arabic translation within three months
The original PoA, legalized through an Arab Consulate, must be submitted within three months from the filing dateTrademark applications claiming conventional priority in Bahrain must be filed within six months of the priority date.

03. TRADEMARK FILING
Bahrain provides two different trademark filing processes: - For Bahraini nationals: Direct filing with the Trademark Office under the Industrial Property Directorate - For foreign applicants: Filing must be conducted through licensed intellectual property firms or trademark agents in Bahrain

04. TRADEMARK ONLINE FILING IN BAHRAIN
To enhance efficiency, Bahrain offers an online portal for trademark registration. This system allows applicants, agents, and residents to submit applications, track progress, and even file opposition claims against trademark applications.

05. TRADEMARK FILING UNDER NICE CLASSIFICATION
Trademark applications in Bahrain must adhere to the NICE Classification, an internationally recognized system that categorizes goods and services. However, Bahrain does not allow multi-class trademark applications; separate applications must be filed for each class.

06. EXAMINATION
Once an application is submitted, the Trademark Office conducts an official examination. The process involves verifying the uniqueness of the mark, ensuring compliance with legal requirements, and identifying any potential conflicts with existing trademarks. If any issues arise, the applicant will receive an official objection notice.

07. PUBLICATION IN THE OFFICIAL GAZETTE
If a trademark passes examination, it proceeds to publication in the Official Gazette of the Patent and Trademark Office. This marks the beginning of a 60-day opposition period, during which third parties can raise objections to the trademark registration.

08. REGISTRATION OF THE MARK
If no opposition is raised within the 60-day period, the Industrial Property Directorate of Bahrain grants official trademark registration and issues a registration certificate. Once registered, businesses can legally use the Ⓡ (Registered Trademark Symbol) to signify ownership.

09. TRADEMARK VALIDITY
A registered trademark in Bahrain remains valid for 10 years from the date of filing.

10. RENEWAL
Trademark owners can renew their registration every 10 years. A six-month grace period is available for late renewals. Even if a trademark expires and is not renewed within the grace period, third parties cannot register the same trademark for up to three years after its cancellation.

11. USE REQUIREMENT
Trademark owners must actively use their registered marks. If a trademark remains unused for five consecutive years, it may be subject to cancellation.
