How to File a Design Application in India

1. Prepare Your Application

To start the process, you need to fill out a completed application form as per Section 5 of the Indian Designs Act, 2000. The application should include:
- Two Copies of Images/Views: You will need to submit six views of your design: front, rear, top, bottom, left side, right side, and a perspective view.
- Applicant’s Details: Provide the name, address, and legal status of the applicant (whether individual, company, or any other entity).
- Design Details: You must specify the class in which your design belongs and the article to which the design applies.
- Fees: Pay the prescribed official fees for filing the application.
- Statement of Novelty: Submit a brief statement describing the novel features of the design.

2. Filing Location

Applications can be filed at the Design Wing of the Patent Office in Kolkata.

3. Online Filing Option

For convenience, the Design Application Filing India process has been digitized. Applicants can file their applications online through the official portal of the Controller General of Patents, Designs, and Trademarks. This online facility provides easy payment options via net banking, debit/credit cards, and ATM cards.

4. Examination of the Design

Once the application is filed, it undergoes an examination to ensure that the design is new and meets the criteria set out in the Design Act. No separate request for examination is needed in India. If any defects are found, the applicant will be notified and given six months to correct them.

5. Objections & Hearings

If objections arise during the examination, the applicant has the chance to rectify the issues and resubmit the application. In cases where objections are not resolved, a personal hearing can be requested, where the Controller will make a final decision.

6. Registration and Publication

If the design is accepted, it will be registered and published in the official gazette. A certificate of registration will be issued, confirming the protection of your design for a specified period.
